6 Thoughts on Australian politicians openly inciting employers to break the law
Hey employers...don't do it!
The government wants to get the whole population jabbed with an experimental liquid that skipped animal testing and clinical phase 3 trials not completing until 2023 (what’s the point of the trial now?).
They have set an 80% target which is higher than almost any other country and is effectively the whole population.
But they have a constitutional problem. They cannot mandate vaccination.
1. Section 51 of the Australian Constitution
The wonderful Augusto Zimmermann recently explained it here:
Constitutionally Inoculated to Resist Coercion
In other words, no Australian government, either federal or state, or those acting on its behalf, is constitutionally authorised to force any individual to take medicament against his or her own will, or force them or their children to be, among other things, compulsorily vaccinated.
That important decision confirmed the fundamental right of Australian citizens to determine by their own will whether they should take any medical or pharmaceutical benefit provided.
To conclude: the Australian Constitution explicitly prohibits any form of legal compulsion upon the medical profession to carry out any form of medication, including vaccination. In fact, no government, either federal or state, can impose compulsory vaccination in this country, or prevent medical practitioners from remaining entirely free to choose whether or not to provide certain medical services, including vaccination.
So, they have a problem. But for Section 51, they would have simply forced it upon us. But that would be too blatant.
2. Scott Morrison
Which bring us to this hollow man.
"We do not have a mandatory vaccination policy in this country. We are not proposing that. That is not changing," he told reporters in Canberra on Friday following a national cabinet meeting.
“Ultimately, employers need to consider these matters and make their own decisions.
“Where an employee may be at great risk of actually contracting the virus, the employer would be in those circumstances seeking to afford some protection for their staff and upholding - in their view - their obligations regarding the occupational health and safety of their staff.”
I have repeatedly talked about what Fascism means. It is when government and business comes together against the citizen. Read Point no.1 here.
11 Insights into The Medical-Government-Media (MGM) Triad
What is happening in real time is that government is openly calling on business to do its dirty work. MANY employers will go down this path, they have been given the green light. The owners are terrified of COVID because of the government’s most successful fear mongering.
Their propaganda campaign has shifted the public to thinking that the Infection Fatality Rate of COVID is 38% vs the reality of 0.15%. That is a 250x amplification from reality.
So, terrified employers will start asking for it to keep themselves and their staff “safe”. This is a green light for monomaniacal safetyism to sweep the country with an army of business owners, CEOs, heads of human resources and health and safety departments, who have lost their backbone and critical thinking ability, to wage an assault on the free will of terrified employees.
Many employees will love this because they too are terrified (38% vs 0.15%) and want their employer to “keep them safe”.
This sanctioned pincer movement will come after that portion of the country that does not want to take the experimental, and now known to be toxic, injection.
3. Liberal Party Values
Before I move on from Hollow Man. He leads the Australian Liberal Party.
I would like everyone to take a moment to read what their stated beliefs are, and try not to laugh:
We Believe:
in the inalienable rights and freedoms of all people: we work towards a lean government that minimises interference in our daily lives and maximises individual and private-sector initiative;
in government that nurtures and encourages its citizens through initiative, rather than putting limits on people through the punishing disincentive of burdensome taxes and the stifling structures of Labor’s corporate state and bureaucratic red tape;
in those most basic freedoms of parliamentary democracy – the freedom of thought, worship, speech and association;
in a just and humane society in which the importance of the family and the role of law and justice are maintained;
in equal opportunity and tolerance for all Australians;
in the encouragement and the facilitation of wealth so that all may enjoy the highest possible standards of living, health, education and social justice;
that, wherever possible, government should not compete with an efficient private sector, and that businesses and individuals – not government – are the true creators of wealth and employment;
in the Australian Constitution;in preserving Australia’s natural beauty and environment for future generations; and
that our nation has a constructive role to play in maintaining world peace and democracy
through alliances with other free nations.
In short, we believe in individual freedom and free enterprise.
A friend brought this to my attention recently. I honestly thought it was a joke.
The party that “believes in individual freedom” is calling on employers all over the country to deny the citizens of this great country that very freedom to decide what the hell they inject into their body.
Hannah Arendt captured the spirit of evil perfectly when she wrote:
“Good can be radical; evil can never be radical, it can only be extreme, for it possesses neither depth nor any demonic dimension yet--and this is its horror--it can spread like a fungus over the surface of the earth and lay waste the entire world.
Evil comes from a failure to think.
It defies thought for as soon as thought tries to engage itself with evil and examine the premises and principles from which it originates, it is frustrated because it finds nothing there.
That is the banality of evil.”
Scott “Hollow Man” Morrison is an unthinking person.
He is now conscripting 10,000s of owners and decision makers from across the country to wage an unthinking war on the free citizens of this country.
4. Gladys Berejiklian
This unthinking, evil woman is the NSW Premier.
She picks up what Hollow Man started.
On 5 August she openly called on employers to “put pressure on your staff to get vaccinated”.
If you are an employer and you are reading this, this is your moment to stand up to fascism. This is it. You have arrived at a cross roads. Will you go towards the light or towards darkness. There is more than enough information out there now about the problems with the untested jabs, you simply have to be curious enough and bothered enough to find out and protect your staff from this unthinking madness.
5. Australian Vaccination Handbook
Both Scott and Gladys are openly calling for employers to coerce their employees.
Clearly the power dynamic is with the employer and the smallest hint from them that they would like staff vaccinated will be sufficient for many to do so. Staff will not want that unknown hanging over their head.
What if they don’t promote me for not getting the jab?
What if I don’t get the pay raise in a month?
What if they just decide to let me go in a few months and disguise it as another reason?
Many are casual or on contracts. A large portion of the work force has very low job security to begin with.
What if they don’t renew my contract?
Or simply find an excuse to make me redundant?
The “pressure tools” or “tools of coercion” available to an employer are endless.
This is something that Scott and Gladys know.
So, let’s look at coercion and what the government’s own vaccination guidelines are:
Preparing for vaccination | The Australian Immunisation Handbook
In the Preparing for vaccination section, you will find this:
Criteria for valid consent
For consent to be legally valid, the following elements must be present:
1. It must be given by a person with legal capacity, and of sufficient intellectual capacity to understand the implications of receiving a vaccine.
2. It must be given voluntarily in the absence of undue pressure, coercion or manipulation.
3. It must cover the specific procedure that is to be performed.
4. It can only be given after the potential risks and benefits of the relevant vaccine, the risks of not having it, and any alternative options have been explained to the person.
So, there it is, in point 2 and in plain sight.
Scott and Gladys are openly calling for employers to apply DUE pressure, coercion, and manipulation.
6. Fair Work Ombudsman
And while we are on the subject, let’s look at what the Ombudsman has to say about workplace rights and vaccination.
COVID-19 vaccinations: workplace rights & obligations
Here are some highlights:
In the current circumstances, the overwhelming majority of employers should assume that they can’t require their employees to be vaccinated against coronavirus.
There are limited circumstances where an employer may require their employees to be vaccinated.
Bottom line. Employers are not allowed to do it, except in very limited circumstances.
But they are being incited to do it, with more than a wink, in the implied promise that they will not be prosecuted for breaking the law.
